DMCA Policy
Geekzilla.Io Geekbar respects the intellectual property rights of others and expects its users to do the same. In accordance with the Digital Millennium Copyright Act (DMCA) and other applicable laws, we have adopted a policy of terminating, in appropriate circumstances, users who are deemed to be repeat infringers.
We will respond expeditiously to claims of copyright infringement committed using the Geekzilla.Io Geekbar service that are reported to our Designated Copyright Agent, identified in the sample notice below.
Filing a DMCA Notice of Infringement
If you are a copyright owner, or are authorized to act on behalf of one, and you believe that your copyrighted work has been copied in a way that constitutes copyright infringement and is accessible via the Geekzilla.Io Geekbar service, please send a written DMCA Notice of Infringement to our Designated Copyright Agent with substantially the following information:
- An electronic or physical signature of the person authorized to act on behalf of the owner of the copyright interest.
- A description of the copyrighted work that you claim has been infringed, including the URL (i.e., web page address) of the location where the copyrighted work exists or a copy of the copyrighted work.
- Identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit us to locate the material (e.g., the URL(s) of the infringing content on Geekzilla.Io Geekbar).
- Your address, telephone number, and email address.
- A statement that you have a good faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law.
- A statement, made under penalty of perjury, that the above information in your Notice is accurate and that you are the copyright owner or authorized to act on the copyright owner's behalf.
Please note that this procedure is exclusively for notifying Geekzilla.Io Geekbar and its affiliates that your copyrighted material has been infringed. Falsely claiming copyright infringement may result in liability for damages.
Filing a DMCA Counter-Notification
If you believe that the material you posted on Geekzilla.Io Geekbar was removed or access to it was disabled by mistake or misidentification, you may file a Counter-Notification by providing our Designated Copyright Agent with substantially the following information:
- Your physical or electronic signature.
- Identification of the material that has been removed or to which access has been disabled and the location at which the material appeared before it was removed or access to it was disabled.
- A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled.
- Your name, address, and telephone number.
- A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located, or if your address is outside of the United States, for any judicial district in which Geekzilla.Io Geekbar may be found, and that you will accept service of process from the person who provided the original DMCA notification or an agent of such person.
Upon receipt of a valid Counter-Notification, we will promptly provide the complaining party with a copy of the Counter-Notification and inform them that we will replace the removed material or cease disabling access to it within 10 business days. We will replace the removed material or cease disabling access to it in not less than 10 nor more than 14 business days following receipt of the Counter-Notification, unless our Designated Copyright Agent first receives notice from the person who submitted the original DMCA Notification that such person has filed an action seeking a court order to restrain the user from engaging in infringing activity relating to the material on our system.
